Practice AreasAutomotive Seat Back Cases Collapsing Seatbacks Present A Serious Danger In Accidents In head-on collisions, the seatbelt and shoulder harness are designed to restrain the driver or front seat passenger from moving forward and being injured by contact with the steering wheel, dashboard or windshield. In rear impact collisions, the forces of the accident work in reverse and the backs of the front seats are supposed to work in the same way that the seatbelt and shoulder harness work in frontal collisions. Too often, however, the seatbacks collapse, and when that happens serious spinal cord injuries or death often result. We have represented several clients who are now quadriplegics because of improperly designed seatbacks. These are very upsetting cases that could have been easily prevented with simple, inexpensive changes in the seat design. The manufacturers are aware of the problem but have done little to fix it. It is our hope that, through lawsuits such as the ones that we have successfully handled, the manufacturers will finally decide that from a legal, economic and moral perspective they are better off redesigning the seats and reducing the risk of these very severe injuries.
