Legal Malpractice
Legal malpractice is the failure of a lawyer to render competent professional service to a client. If the client is damaged as a result of the failure, he or she may have a claim against the lawyer for legal malpractice.
Legal malpractice claims are based on three broad legal theories:
- Negligence – representation that falls below the standard of care
- Breach of fiduciary duty – conflicts of interest and other acts of attorney self-interest
- Breach of contract – violation of some aspect of the contract between client and attorney
